Terms of Service

1. General Provisions

These Terms of Service (hereinafter — "Terms") constitute a legally binding agreement between you (hereinafter — "User", "you") and Individual Entrepreneur Roman Borisovich Belov (TIN 770871362722, OGRNIP 322774600177836, hereinafter — "Operator", "we", "JourneyBay") regarding the use of the JourneyBay mobile application and website journeybay.co (collectively — "Service").

By registering for or using the Service, you confirm that you have read and agree to these Terms, the Privacy Policy, Cookie Policy, Acceptable Use Policy, and Refund Policy in their entirety. If you disagree with any part of the Terms, do not use the Service.

2. Description of Service

JourneyBay is a travel planning platform powered by artificial intelligence (hereinafter — "AI"). The Service provides:

  • AI-generated itineraries and trip plans
  • Personalized place and activity recommendations
  • AI assistant (chatbot) for travel-related questions
  • Nearby place search
  • Visa, weather, currency, and entry requirement information
  • Trip preparation checklists
  • Other features as described in the application

3. Age Requirements

The Service is intended for persons aged 16 years and older. By registering, you confirm that you are at least 16 years old. If you are between 16 and 18 years old, you confirm that your legal guardian has reviewed these Terms and consented to your use of the Service.

We do not knowingly collect personal data from persons under 16. If we become aware of such collection, the data will be promptly deleted.

4. Registration and Account

Registration is required to use the Service. You agree to:

  • Provide accurate and current information during registration
  • Maintain the confidentiality of your credentials and not share account access with third parties
  • Immediately notify us at [email protected] of any unauthorized access to your account
  • Maintain no more than one account

You are fully responsible for all activities conducted under your account. We reserve the right to suspend or delete your account for violation of these Terms or the Acceptable Use Policy without prior notice and without compensation.

5. Subscription and Payments

5.1. TripPass PRO

The paid TripPass PRO subscription provides full access to Service features. The following options are available:

  • Monthly subscription — auto-renewal every month
  • Trip Pass (2 months) — one-time payment, no auto-renewal
  • Annual subscription — auto-renewal once a year

Current prices are displayed in the application and on the website. We reserve the right to change prices with at least 30 days' notice. New prices apply from the next subscription period.

5.2. Payment Processing

Payments are processed through T-Bank (Tinkoff Acquiring). Your bank card details are processed and stored exclusively by the payment provider in accordance with PCI DSS standards. JourneyBay does not receive or store complete card data.

5.3. Auto-Renewal

Auto-renewing subscriptions (monthly and annual) automatically renew at the end of the current period. Payment is charged 24 hours before the current period expires. To cancel auto-renewal, deactivate your subscription in the app settings no later than 24 hours before the current period ends.

5.4. Free Trial

New users may receive a free trial period of up to 7 days. After the trial period, the paid subscription begins automatically unless cancelled before the trial expires. The trial period is offered once per user.

5.5. Refunds

All purchases are final and non-refundable. Detailed terms are set forth in the Refund Policy. We recommend using the free trial period to evaluate the Service before purchasing.

6. AI Tokens

AI features use a token system. The PRO subscription includes 25,000 tokens per subscription period. Additional tokens can be purchased separately.

  • Tokens are not currency or securities and have no monetary equivalent
  • Unused tokens do not carry over to the next subscription period
  • Separately purchased tokens are valid for 12 months from the date of purchase
  • Tokens are non-transferable, non-tradeable, and non-exchangeable
  • Refunds for unused tokens are not available, except as required by applicable law

7. Artificial Intelligence — Important Warnings

Please read this section carefully. It significantly affects your rights and expectations regarding the Service.

7.1. Nature of AI Content

The Service uses generative artificial intelligence technologies (including large language models) to create itineraries, recommendations, and responses. AI content is generated automatically based on statistical models and may contain errors, inaccuracies, outdated information, or entirely fabricated data (so-called "hallucinations").

7.2. AI Is Not a Professional Advisor

The JourneyBay AI assistant does not replace professional advice in the following areas:

  • Travel safety — AI does not assess crime rates, military conflicts, natural disasters, epidemiological conditions, or other threats in specific regions
  • Visa and immigration matters — visa requirements, entry rules, customs regulations, and immigration policies may be incomplete, outdated, or inaccurate. Always verify information through official sources (embassies, consulates, government portals)
  • Health and medicine — AI does not provide medical advice, including information about vaccinations, health insurance, water and food safety
  • Legal matters — AI is not a source of legal advice regarding the laws of your destination country
  • Financial matters — prices, exchange rates, and service costs may be outdated

7.3. Non-Existent Places and Entities

AI may recommend places, restaurants, hotels, or attractions that do not exist, have closed, changed operating hours, or relocated. Before visiting any location, we recommend independently verifying its existence and the accuracy of the information.

7.4. Assumption of Risk

By using the Service for travel planning, you acknowledge and accept that:

  • Travel involves inherent risks for which JourneyBay bears no responsibility
  • You bear full and exclusive responsibility for your safety, health, and property during travel
  • You are obligated to independently verify all critical information (visas, entry rules, safety, health) through official sources
  • The decision to travel and follow an itinerary is made exclusively by you at your own risk

8. Intellectual Property

8.1. JourneyBay Rights

All rights to the Service, including but not limited to: source code, design, interface, databases, algorithms, AI models, trademarks, logos, text and graphic content — belong to IE Roman Borisovich Belov or are used under license. Any reproduction, copying, distribution, or other use without written permission of the Operator is prohibited.

8.2. AI-Generated Content

All content created by JourneyBay's AI systems (itineraries, recommendations, place descriptions, AI assistant responses, and any other AI output) is the intellectual property of JourneyBay. The Operator grants you a limited, non-exclusive, non-transferable, revocable license to use AI-generated content solely for personal, non-commercial purposes.

8.3. User-Generated Content (UGC)

By posting, uploading, publishing, or otherwise providing content through the Service (including but not limited to: reviews, trip notes, photos, chat messages, preference data, place ratings, any texts and materials — hereinafter "User Content"), you grant JourneyBay:

  • An exclusive, perpetual, irrevocable, worldwide, royalty-free license with the right to sublicense to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display the User Content in any manner and for any purpose, including:
  • Providing and improving the Service
  • Training and improving AI models
  • Personalizing recommendations for you and other users
  • Marketing and commercial purposes (in anonymized form)
  • Analytics and research

You confirm that you hold all necessary rights to the User Content and that its publication does not infringe the rights of third parties. You irrevocably waive any claims for compensation for the use of User Content under this license.

JourneyBay reserves the right to remove User Content that violates these Terms, the Acceptable Use Policy, or the rights of third parties without prior notice.

9. Rules of Use

When using the Service, you agree to comply with the Acceptable Use Policy, which forms an integral part of these Terms. In particular, you must not:

  • Violate applicable laws of the Russian Federation or your country of residence
  • Use the Service to plan illegal activities
  • Attempt to circumvent AI system limitations (prompt injection, jailbreaking), manipulate AI output, or use AI to generate harmful, illegal, or misleading content
  • Use automated tools (bots, scrapers, crawlers) to interact with the Service
  • Reverse engineer, decompile, or disassemble the Service or its components
  • Resell, transfer, or sublicense access to the Service or your account
  • Distribute malware, spam, or phishing content through the Service
  • Disrupt Service operation or place excessive load on the infrastructure

Violations may result in suspension or termination of access to the Service without reimbursement.

10. Limitation of Liability

10.1. Service "As Is"

The Service is provided on an "as is" and "as available" basis without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, error-free or uninterrupted operation.

10.2. AI Disclaimer

To the maximum extent permitted by applicable law:

  • We do not guarantee the accuracy, completeness, timeliness, reliability, or trustworthiness of any AI-generated content
  • We are not liable for decisions made by you based on AI content
  • We are not liable for losses, damages (including personal injury, property damage, emotional distress), lost profits, or any other losses directly or indirectly related to the use of AI content
  • We are not liable for the actions or omissions of third parties (airlines, hotels, restaurants, tour operators, etc.) whose information was provided by AI

10.3. Liability Cap

In any event, JourneyBay's aggregate liability for all claims related to the Service is limited to the amount actually paid by you for using the Service during the 12 months preceding the event giving rise to the claim, or 5,000 Russian rubles — whichever is greater.

10.4. Force Majeure

We are not liable for failure to perform obligations caused by force majeure, including but not limited to: natural disasters, military actions, pandemics, government orders, internet outages, or third-party service failures.

11. Indemnification

You agree to indemnify and hold harmless JourneyBay, its employees, and partners from all losses, expenses, including reasonable legal fees, arising from:

  • Your violation of these Terms or the Acceptable Use Policy
  • Your infringement of third-party rights
  • Any third-party claims related to your User Content
  • Your use of the Service in violation of applicable law

12. Termination

You may stop using the Service at any time by deleting your account in the app settings or by contacting [email protected]. Upon account deletion:

  • Active subscription remains valid until the end of the paid period (no refund)
  • Unused tokens are forfeited
  • Personal data is deleted within 30 days per the Privacy Policy
  • The license for User Content granted under section 8.3 survives termination

We reserve the right to suspend or terminate your access to the Service for violations of these Terms, the Acceptable Use Policy, or as required by authorized government bodies.

13. Changes to Terms

We reserve the right to modify these Terms. We will notify you of significant changes through the app or by email at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you disagree with the changes, you may stop using the Service and delete your account.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Russian Federation.

In case of disputes, the parties shall endeavor to resolve them through pre-trial settlement. Claims should be sent to [email protected] with a description of the claim. Response time is 30 days.

If pre-trial settlement is not possible, disputes shall be resolved by the courts at the location of the Operator (Moscow, Russian Federation) in accordance with applicable law.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid one that most closely reflects the intent and purpose of the original provision.
